Eh. The lawyers for the USCG are shysters of the first order because of the ad hoc, 'well, we just have to do it this way because it's not efficient to try these cases in a procedurally proper fashion, your honor!' approach they take to the law.
That said, their clients tend to have legitimate claims against the idiots who think they can lose their online copyright infringements in the mass of traffic on various sites.
The lawyer who put together the forms has a good idea, but looks to have gone about it in a pretty sloppy way, and then put some statements in the record by emailing the USCG's lawyer something nobody who graduated from law school should have ever written, much less sent:
Syfert [defense lawyer] then flipped out and sent a ‘tongue in cheek’ email to Weaver [USCG lawyers] asking them to offer him a $200,000 per year job, or contact someone who actually gives a fuck. “Hire me or eat shit,” he ended his email.
Courts know that USCG's lawyers are playing fast and loose with federal procedure and probably don't like it, but they'll like this sort of extortion looking stuff even less. The idiot lawyer may well get sanctioned.
